Federal Trademark Registration Application (USPTO)

$250.00

Scope of Legal Services: The Gonzalez Law Office, PLLC ("Firm") shall provide flat-fee legal representation for the preparation, prosecution, and electronic filing of one (1) federal trademark or service mark application before the United States Patent and Trademark Office ("USPTO") in one (1) International Class of goods or services. This flat-fee engagement encompasses the following specific deliverables:

  • Preliminary Knockout Search & Risk Assessment: Conducting a preliminary conflict search of the USPTO federal database to identify direct knockouts or substantially similar registered or pending marks that may pose a likelihood-of-confusion refusal under Lanham Act § 2(d) (15 U.S.C. § 1052(d)), coupled with an attorney assessment of distinctiveness and registrability.

  • Classification & Filing Basis Strategy: Legal counsel regarding appropriate International Class selection under the Nice Agreement, drafting compliant descriptions of goods/services, and determining the appropriate statutory filing basis under Section 1(a) (Use in Commerce), Section 1(b) (Intent-to-Use), or Section 44 (Foreign Application/Registration).

  • Specimen Review & Application Drafting: Review of commercial specimens of use (for Section 1(a) filings) to verify compliance with USPTO examination guidelines, preparation of the formal trademark application, and electronic submission via the USPTO Trademark Center.

  • Docketing & Procedural Monitoring: Serving as the Attorney of Record with the USPTO, monitoring application status throughout the initial examination lifecycle, and forwarding official USPTO correspondence.

Exclusions & Statutory Filing Fees:

  • Government Filing Fees Excluded: This flat legal fee covers professional attorney services only and excludes mandatory USPTO government filing fees (currently $350.00 USD per International Class for standard electronic filings, plus any applicable USPTO surcharge for custom descriptions), which shall be billed separately prior to submission.

  • Excluded Post-Filing & Contested Matters: Unless expressly agreed to in a separate written addendum, this flat fee does not include comprehensive common-law clearance opinions, responses to substantive Office Actions (e.g., § 2(d) likelihood of confusion or § 2(e) mere descriptiveness refusals), Statements of Use or Requests for Extension of Time under Section 1(b), Petitions to the Director, or inter partes opposition/cancellation proceedings before the Trademark Trial and Appeal Board ("TTAB").

  • Important Notice & Ethics Disclaimer: Submission of payment via this website does not automatically establish an attorney-client relationship. Any formal representation is strictly contingent upon the Firm’s completion of an internal conflict-of-interest check and the mutual execution of a formal Engagement Agreement. No guarantee or warranty is made regarding the ultimate registration approval of any mark by the USPTO Examining Attorney.
